But isn't this a positive development, Bloop? I've tended to side with the Lore/ARod team in this dispute, but only because of their "star power"...they are certianly "cooler" than Glen. But I also have to admit that there is much that I don't know about this case. Glen has stated that Lore/ARod submitted a budget to the NBA that slashed payroll by a significant amount, but the NBA has refused to get involved, so we don't know what the real story is. So now Glen is subpoenaing the league to make the private conversations public. Isn't that exactly what we want too? Don't we want to know whether or not the potential new owners really intend to slash payroll as Glen claims. It would help me answer this question for myself: Who do I want as my ownership group...a team with star power who intends to slash payroll, or a nerdy guy who's willing to go well into the luxury tax in order to be competitive?

Right now I continue to support the Lore team based on my limited knowledge. But if the subpoenaed information supports Glen's claim (and I suspect it does...why else would he be issuing a subpoena?), my allegiance will quickly change. We need more information to make an informed opinion, and this can only help. Let's hope we hear something from Silent Silver soon.

Dirty? What is dirty about a subpoena? Glen is exercising his legal rights as he should.

I think it qualifies as “dirty” or at least sort of slimy because the information he’s seeking is not relevant to the dispute. The dispute has nothing to do with how much the owners are willing to spend on payroll or on who fans would prefer as owners. The dispute relates solely to the terms of the purchase agreement - specifically whether Lore’s group satisfied their obligations under the contract to close on the purchase of the remaining 60% of the team. As we’ve read, the dispute is about whether Lore’s group provided the necessary financial commitments by the contractual deadline to extend the period for payment pending League approval. Glen’s position is that Lore’s group was required to transfer the money by that deadline to trigger the extension. The Lore group contends that they just needed to show proof that they had the money (financial commitments) to pay the balance, after which the money would transfer upon League approval. Glen’s position seems lame to anyone who does these deals. You don’t pay for something before you’re entitled to have it and Lore’s group would not be entitled to own the team without first getting League approval. That was obviously the whole point of the extension - i.e., to give time for League approval once the buyers were able to show they had the money to complete the deal.

Glen’s case seems really weak to me. What do you do when you have a really weak case? Answer: You throw crap on the wall to see what sticks. Glen is fishing for information that could get leaked and embarrass either the Lore group or the the League (or both) in an effort to get the Lore group to back out of the deal or create pressure by the League on the Lore group to back out. Glen is famous for leaks. He’s known for cheating. He somehow managed to incur the lifelong wrath of the best player in franchise history who calls Glen a snake. I don’t think there’s much doubt here that Glen is playing dirty. As many on this Board know, I defended Glen for many years. But over the years, I’ve developed an understanding of him as someone who is petty and who I would never trust. So yes, I think he’s playing dirty. And I think he’ll lose. Meanwhile, he is putting this franchise and its fans through a period of needless, exhausting and potentially franchise-damaging uncertainty.
